A middle-aged woman has been arraigned before a Kabarnet court for being in possession of 955 cartridges without a firearms certificate.
It is alleged that on November 6, this year, at Marigat location of Marigat Sub County within Baringo County, Grace Muthoni was found in possession of 951 empty blank cartridges and four blank cartridges of 7.62 by 39mm.
Muthoni who appeared before Senior Principal Magistrate Purity Kosgei on Tuesday was charged for being in possession of ammunition without a firearms certificate contrary to section 4A (1) (a) of the firearms amendment Act No.6 of 2010.
The court was told that the suspect was lacking a firearm certificate therefore raising suspicion amongst police officers from Marigat police station who were acting on a tip off from members of the public about its intended use.
When she was presented before court to answer the charges, the accused pleaded not guilty to the accusations.
“Your honour, I am a resident of Marigat and I was not owning the said cartridges,” Muthoni said in mitigation.
The prosecution counsel Joseck Abwajo in his submissions prayed the court not to release the suspect on bond noting that she has no fixed place of abode and may abscond.
The Magistrate in her ruling ordered the accused to remain in custody for the interim as they wait for pre-bail reports to determine if she is fit for bond or not.
The case will come up for mention on November 21 when a hearing date will be fixed, with four witnesses lined up to testify.
