A young man who smashed a matatu windscreen valued at Sh 10,000 and injured a passenger has been arraigned before a Kabarnet court charged with malicious damage to property.
Johana Chebon Kibet appeared before Principal Magistrate Caroline Ateya charged that he committed the offense on June 16, 2023 at Marigat Township in Marigat sub county at around 3pm.
The accused who pleaded not guilty was released on a personal bond of Sh50,000 with one surety of the same amount or alternative cash bail of Sh 8,000.
The court heard that on the material day at around 3 pm, the accused willfully and unlawfully damaged the left windscreen of a Toyota Shark Matatu registration number KDD 764R owned by Elijah Koima.
Prosecutor Rebecca Bartilol stated that the incident which was contrary to Section 339 (1) of the Penal code occurred when the matatu driver was traveling from Kabarnet enroute to Nakuru city.
After dropping off some passengers at Marigat bus terminus before proceeding towards Nakuru, the accused who was standing by the roadside, threw a stone that hit the left passenger window causing significant damage and unfortunately it hit one of the passengers resulting in minor injuries.
Realizing what had transpired, the driver promptly stopped the vehicle and apprehended the accused and the incident was reported to the authorities where a formal complaint was lodged at Marigat police station.
The damaged windscreen and the stone used to hit the passenger vehicle were presented to court as exhibits for proving the case against the accused.
While denying the charges preferred against him, the accused argued that some of the claims made were false and that he does not understand how the extra accusations were added at the courtroom.
The Magistrate scheduled the case for hearing on July 4 when three witnesses are set to testify.
