A Police officer attached at the Kiganjo Police Training College has been charged before a Nyeri court with sexually assaulting a two-and-a-half-year-old girl.
Sylvester Kirwa who had appeared before Resident Magistrate Mercyline Lubia to answer to the charges has however denied the charges which are contrary to the Sexual Offences Act of 2006.
According to the charges, the accused who is facing two criminal counts including touching the minor’s private parts and having actual carnal knowledge with the girl is said to have committed the offence on May 9, 2022 at.8 25 am.
He allegedly committed the crime within the Kiganjo Police Training College premises.
Kirwa was arrested on September 8, 2022 and taken to Kiganjo Police station where charges of defilement were preferred against him. He was later released on a Sh 20,000 police cash bail.
His lawyer Njuguna Kimani pleaded with the court that he be given a reasonable cash bail or he could deposit his passport.
“I propose that you consider releasing my client on Sh 100,000 cash bail as he awaits the pre –trial at the next hearing,” he says. The prosecution opposed the lawyer’s request saying the accused may tamper with witnesses.
The court has ordered that the police cash bail of Sh 20,000 be refunded to the accused and he be released on bond of Sh 300,000 with a surety of similar amount or a cash bail of Sh 200,000.
Kirwa is expected to appear in court again on September 27 for the mention of the case.
