Juja Constituency parliamentary aspirant for Jubilee party Aloise Kinyanjui has filed an election petition at the High Court in Kiambu challenging the election of George Koimburi citing election malpractice.
Through his lawyer Ndegwa Njiru, Kinyanjui challenged Koimbori’s win claiming the election was not free and fair.
According to court documents viewed by KNA, Kinyanjui who vied on a Jubilee ticket cited that Independent Electoral and Boundaries Commission (IEBC) Juja returning officer did not comply with the law relating to elections while conducting the elections for Juja parliamentary seat last August 9.
The petitioner accused IEBC of failing in its mandate by denying 62 out of 213 of his agents to access polling stations and discharge their mandate as his representatives.
“IEBC denied 62 validly appointed agents into polling stations hence declaring 25,570 votes in the same polling stations whose votes were inaccurate, unverifiable and unaccountable,” reads part of the affidavit. IEBC has been listed as a respondent in the suit.
The petitioner also faulted the commission claiming that it granted access to 33 persons in to 33 polling stations when they said they were not appointees of the petitioner and who should not have had access to the polling station.
“The 33 imposters were irregularly given access to the polling stations claiming to be my agents. They remain strangers to me as they did not appear in my list of the duly verified agents,” he added.
Kinyanjui perpetuated an illegality that persists that IEBC issued two forms of 35(A) for Ndururumo polling station two of six of giving a variance of four unaccountable ballots thereby inflating votes cast giving rise to unexplainable no of 21 votes.

Kinyanjui claims that Koimbori was not duly elected as the MP for Juja and his re- election should be declared null and void.
This happens just hours after the Kenya Supreme Court ruled in favour of William Ruto dismissing several petitions seeking to annul the presidential results of the 9 August election
