Man jailed for stealing motorbike 

A man has been committed to serve two years in jail by a Loitoktok law court for theft of motorcycle.

Albanus Malu Mwangangi was sentenced by Principal Magistrate Judicaster Nthuku Tuesday, after he was found guilty of the offence of stealing motorcycle at Kimana shopping centre on September 3, this year.

Brian Mutambuki, the owner of the motorcycle testified that on the material day, he called the accused to come and pick the motor cycle for cleaning at the car wash where he works.

Mutambuki waited the accused for one hour, but he never returned the motorbike and he went to the car wash and did not find Malu or the motorcycle.

An attendant who works at the car wash informed Mutambuki that the accused person came to the car wash but left soon afterwards without cleaning it.

Later the same day, the accused called the owner of the motorbike claiming that he had given the motorbike to someone else who got a fatal accident, while riding near Winners academy in Kimana township.

They reported the matter at Kimana police post 10:00pm whereby they called the tracking company which traced the motorbike in Tanzania.

The following morning Mutambuki met with tracking agents and traced the accused at Balozi bar and confronted him.

The accused claimed that he gave the motorcycle to someone else to help him start the engine after encountering mechanical issues with the motorcycle. Malu said that the person who was unknown to him started the engine and drove off unceremoniously.

The police however escorted him to Loitoktok police station where he was charged with the offence, before being arraigned in court, where he denied the charges.

But the court noted that prosecution had proved the case beyond reasonable doubt.

The court also noted theft of motorcycles within the locality is on the rise and there was need to curb the menace, hence the deterrent measure of 2 years’ imprisonment.

The accused has14 days to appeal against the sentence.
