Court gears towards handling pending succession cases during the national Service Week

Makueni courts will start handling 471 pending cases of succession during the National Service Week scheduled to take place from 1st to 5th August 1 to 5 in all the four courts in the county, Makueni Resident Magistrate (RM) George Sagero has said.

Consequently, Sagero appealed to all the administrators of the various cases to appear before court to ensure the cases are listed to be heard expeditiously so that the various families can get justice.

At the same time, the RM revealed that the move was aimed at decongesting the courts and also reduce the backlog in the various courts during the period under review.

“I appeal to all those administrators with succession cases to come to our courts in Wote, Makindu, Kilungu and Tawa to ensure the cases are listed. This will help us deal with some of these cases and reduce the backlog in our courts,” said Sagero while speaking to KNA in his Wote office on Thursday morning.

The current move is a directive from the Chief Justice (CJ) Martha Koome in an Internal Memo dated July 20, 2022 requiring all courts in Kenya to expeditiously hear succession matters especially those that have been pending in court for a long time so as to help the Judiciary achieve its vision.

In the internal memo, the CJ said that by March 31, 2022, there were probate and administration cases that constituted 20% of the caseload in the High Court and 7% in the Magistrate court.

“These case require expeditious handling so that the beneficiaries of the deceased,” many of whom are vulnerable access their inheritance,” said Koome.
