A man who pleaded guilty to stealing a motorbike at Ololunga area in Narok South Sub-county has been fined Sh40,000 or six months imprisonment.
Festus Kimwero, who was convicted by Narok Resident Magistrate, Daniel Ngayo, pleaded for forgiveness, saying he stole the bike to sustain his family and get money to attend to his sick mother.
The prosecution told the Court that on 10th of November 2021 at 8:30pm the complainant Mr. Wesley Mutai, met with the accused, whom he had hired to ride his motorcycle, at Ololunga junction.
The complainant questioned why he was still riding at that time yet in their agreement he was supposed to finish his daily work at 7pm.
He, however, assured him that he would return the motorcycle safely after finishing his work. However, the following morning, the complainant did not find the motorbike, triggering him to look for the accused.
But when he found the accused, he alleged the motorbike had been stolen that night and he was on his way to look for it.
However, he indicated that he had not reported the matter to the police station.
Together, the prosecution went on, they reported the matter at Olulunga Police Station, which led to the arrest of the accused and the launch of investigations.
The motorcycle was tracked and the last place the tracker was on was at Ewaso Nyiro area and when the police went to the area, they found the tracker beside the road but no motorcycle.
The accused later confessed to knowing where the bike was and on 14th November 2021, he led the complainant and the Investigating Officer to his sister’s home, where they found the motorcycle parked.
The sister said Kimwero claimed he had bought the motorbike registration number KNFQ 405T at Sh90,000.
